New Delhi, 21st Nov. A district court has ordered the attachment of Bikaner House, a property owned by the Nokha Municipal Council of Rajasthan, for failing to comply with an arbitral award of ₹50.31 lakh in favor of Enviro Infra Engineers Private Limited.
District Judge Vidya Prakash issued the directive after noting that the 2020 arbitral award had attained finality when an appeal by the municipal council was dismissed earlier this year.
In a September 18 order, the judge highlighted the council’s non-compliance with previous directives. “The judgment debtor failed to furnish an affidavit of their assets despite repeated opportunities. The court finds it a fit case for issuing warrants of attachment against the immovable property, Bikaner House, New Delhi,” the judge stated.
The court also restrained the Nokha Nagar Palika from transferring or altering the property through sale, gift, or any other means. The decision came in response to an enforcement plea by the decree holder seeking execution of the arbitral tribunal’s January 21, 2020 award.
The court has summoned a representative of the Nokha Nagar Palika to appear for the next hearing scheduled on November 29.
